Data protection declaration

 § 1 Information on the collection of personal data

(1) In the following, we inform you about the collection of personal data when using our website. Personal data is all data that can be related to you personally, e.g. name, address, e-mail addresses, user behaviour.

(2) The responsible party pursuant to Article 4 (7) of the EU General Data Protection Regulation (DS-GVO) is GROSSMANN Baugesellschaft mbH, Aschaffenburger Str. 35, 64832 Babenhausen, info@grossmann-baugesellschaft.de, www.grossmann-baugesellschaft.de (see our imprint). You can reach our data protection officer at info@grossmann-baugesellschaft.de or our postal address with the addition “the data protection officer”.

(3) When you contact us by e-mail or via a contact form, the data you provide (your e-mail address, name and telephone number, if applicable) will be stored by us in order to answer your questions. We delete the data accruing in this context after the storage is no longer necessary or restrict the processing if there are statutory retention obligations.

(4) If we use commissioned service providers for individual functions of our offer or would like to use your data for advertising purposes, we will inform you in detail about the respective processes below. In doing so, we will also state the defined criteria for the storage period.

 

§ 2 Your rights

(1) You have the following rights vis-à-vis us with regard to personal data concerning you:

– Right to information (Art. 15 DSGVO).

– Right to rectification (Art. 16 DSGVO) or deletion (Art. 17 DSGVO),

– Right to restriction of processing (Art. 18 GDPR),

– Right to withdraw consent given (Art. 7(3) DSGVO),

– Right to object to processing (Art. 21 GDPR),

– right to data portability.

(2) You also have the right to complain to a data protection supervisory authority about the processing of your personal data by us.

 

§ 3 Collection of personal data when visiting our website

(1) In the case of merely informative use of the website, i.e. if you do not register or otherwise transmit information to us, we only collect the personal data that your browser transmits to our server. If you wish to view our website, we collect the following data, which is technically necessary for us to display our website to you and to ensure its stability and security (legal basis is Art. 6 para. 1 p. 1 lit. f DS-GVO):

– IP address

– Date and time of the request

– Time zone difference to Greenwich Mean Time (GMT)

– Content of the request (specific page)

– Access status/HTTP status code

– Amount of data transferred in each case

– Website from which the request came

– Operating system and its interface

– Language and version of the browser software.

(2) In addition to the aforementioned data, cookies are stored on your computer when you use our website. Cookies are small text files that are stored on your hard drive in relation to the browser you are using and which provide the party setting the cookie (in this case, us) with certain information. Cookies cannot execute programmes or transfer viruses to your computer. They serve to make the internet offer as a whole more user-friendly and effective.

(3) Use of cookies:

(a) This website uses the following types of cookies, the scope and functionality of which are explained below:

– Transient cookies (for this purpose b).

– Persistent cookies (see c).

b) Transient cookies are automatically deleted when you close the browser. These include, in particular, session cookies. These store a so-called session ID, with which various requests from your browser can be assigned to the joint session. This enables your computer to be recognised when you return to our website. The session cookies are deleted when you log out or close the browser.

c) Persistent cookies are automatically deleted after a specified period of time, which may differ depending on the cookie. You can delete the cookies in the security settings of your browser at any time.

d) You can configure your browser settings according to your preferences and, for example, refuse to accept third-party cookies or all cookies. Please note that you may not be able to use all functions of this website.

e) We use cookies to identify you for subsequent visits if you have an account with us. Otherwise you would have to log in again for each visit.

f) The Flash cookies used are not collected by your browser, but by your Flash plug-in. Furthermore, we use HTML5 storage objects that are stored on your end device. These objects store the required data independently of the browser you are using and have no automatic expiry date. If you do not want Flash cookies to be processed, you must install an appropriate add-on, e.g. “Better Privacy” for Mozilla Firefox (https://addons.mozilla.org/de/firefox/addon/betterprivacy/) or the Adobe Flash Killer Cookie for Google Chrome. You can prevent the use of HTML5 storage objects by setting your browser to private mode. We also recommend that you regularly delete your cookies and browser history manually.

 

§ 4 Further functions and offers of our website

(1) In addition to the purely informational use of our website, we offer various services that you can use if you are interested. For this purpose, you will usually have to provide further personal data which we use to provide the respective service and for which the aforementioned data processing principles apply.

(2) In some cases, we use external service providers to process your data. These have been carefully selected and commissioned by us, are bound by our instructions and are regularly monitored.

(3) Furthermore, we may pass on your personal data to third parties if we offer promotions, competitions, contracts or similar services together with partners. You will receive more detailed information on this when you provide your personal data or below in the description of the offer.

(4) If our service providers or partners are based in a country outside the European Economic Area (EEA), we will inform you about the consequences of this in the description of the offer.

 

§ 5 Use of contact forms

(1) Further personal data is only collected if you provide it to us voluntarily via our contact forms. In this case, we collect the information that comes about in the course of contacting you. This includes, in particular, names and transmitted contact data, date and reason for contacting us. We will only use the personal data collected from you for the purpose of providing you with the requested products or services (legal basis Art. 6 para. 1 b) DSGVO), or for other purposes for which you have given your consent (legal basis Art. 6 para. 1 a) DSGVO) and which are described in this data protection declaration. Your consent, for example for the setting of cookies by third-party providers or for web tracking by them, can also be given in the appropriate technical settings of your browser. You have the option to revoke your consent to the processing of personal data at any time.

(2) The data will be deleted as soon as they are no longer required to achieve the purpose for which they were collected. For the personal data from the input mask of the contact form, this is the case when the respective conversation with you has ended. The conversation is ended when the circumstances indicate that the matter in question has been conclusively clarified.

 

§ 6 Objection to or revocation of the processing of your data

(1) If you have given your consent to the processing of your data, you may revoke this consent at any time. Such revocation will affect the permissibility of processing your personal data after you have expressed it to us.

(2) Where we base the processing of your personal data on the balance of interests, you may object to the processing. This is the case if the processing is not necessary, in particular, for the fulfilment of a contract with you, which is shown by us in each case in the following description of the functions. When exercising such an objection, we ask you to explain the reasons why we should not process your personal data as we have done. In the event of your justified objection, we will review the situation and either discontinue or adapt the data processing or show you our compelling legitimate grounds on the basis of which we will continue the processing.

(3) Of course, you can object to the processing of your personal data for advertising and data analysis purposes at any time. § 7 Newsletter

(1) With your consent, you can subscribe to our newsletter, with which we inform you about our current interesting offers. The advertised goods and services are named in the declaration of consent.

(2) We use the so-called double-opt-in procedure to subscribe to our newsletter. This means that after your registration, we will send you an e-mail to the e-mail address you provided, in which we ask you to confirm that you wish to receive the newsletter. If you do not confirm your registration within 24 hours, your information will be blocked and automatically deleted after one month. In addition, we store your IP addresses and the times of registration and confirmation. The purpose of this procedure is to be able to prove your registration and, if necessary, to clarify a possible misuse of your personal data.

(3) The only mandatory information for sending the newsletter is your e-mail address. After your confirmation, we store your e-mail address for the purpose of sending the newsletter. The legal basis is Art. 6 para. 1 p. 1 lit. a DS-GVO.

(4) You can revoke your consent to the sending of the newsletter at any time and unsubscribe from the newsletter. You can declare the revocation by clicking on the link provided in every newsletter email, via a form on the website or by email to info@grossmann-baugesellschaft.de.

(5) We would like to point out that we evaluate your user behaviour when sending the newsletter. For this evaluation, the e-mails sent contain so-called web beacons or tracking pixels, which are single-pixel image files stored on our website. For the evaluations, we link the data mentioned in § 3 and the web beacons with your e-mail address and an individual ID. Links received in the newsletter also contain this ID.

With the data obtained in this way, we create a user profile in order to tailor the newsletter to your individual interests. In doing so, we record when you read our newsletters, which links you click on in them and deduce your personal interests from this. We link this data to actions you have taken on our website.

You can object to this tracking at any time by clicking on the separate link provided in each email or by informing us via another contact channel. The information is stored for as long as you are subscribed to the newsletter. After unsubscribing, we store the data purely statistically and anonymously.

 

§ 8 Data protection for applications and in the application procedure

The data controller collects and processes the personal data of applicants only for the purpose of handling the application procedure. The processing may also be carried out electronically. This is in particular the case if an applicant submits relevant application documents to the controller by electronic means, e.g. by e-mail or via a web form located on the website. If the controller concludes an employment contract with an applicant, the transmitted data will be stored for the purpose of processing the employment relationship in compliance with the statutory provisions. If the controller does not conclude an employment contract with the applicant, the application documents are automatically deleted two months after the notification of the rejection decision, provided that no other legitimate interests of the controller conflict with such deletion. Other legitimate interest in this sense is, for example, a duty to provide evidence in proceedings under the General Equal Treatment Act (AGG).

 

§ 9 Up-to-dateness
